These Terms of Service apply to the use of the JungleBotanics website and purchases made through our online store.
JungleBotanics is operated by JungleBotanics Ltd, a company registered in England and Wales under company number 15608878. References to “JungleBotanics”, “we”, “us” and “our” mean JungleBotanics Ltd.
Our online store is hosted by Shopify, which provides the e-commerce platform that enables us to sell our products to you.
By using our website or placing an order, you agree to these Terms together with the policies made available on our website. Nothing in these Terms affects your statutory rights under applicable UK consumer law.
1. OUR PRODUCTS
JungleBotanics specialises in live plants and related horticultural products.
Live plants are naturally variable. Unless a listing specifically states that you will receive the exact plant photographed, the plant supplied may differ naturally in leaf shape, size, colour, growth pattern and variegation while remaining representative of the product advertised.
Variegation is a biological characteristic that can change as a plant grows. We cannot guarantee the amount, placement or appearance of variegation on future growth unless expressly stated otherwise.
Plant dimensions and pot sizes given in listings are approximate unless stated otherwise.
We make reasonable efforts to ensure product descriptions, photographs, prices and availability are accurate.
2. ORDERS
Placing an order constitutes an offer to purchase the products in your basket.
We reserve the right to decline or cancel an order where reasonably necessary, including where a product is unavailable, an obvious pricing or listing error has occurred, payment cannot be authorised, or we cannot lawfully fulfil the order.
If we cancel an order after payment has been taken, we will refund the relevant amount.
Customers are responsible for providing accurate contact and delivery information when ordering.
3. PRICES AND PAYMENT
Prices are displayed in pounds sterling (GBP) unless stated otherwise.
Delivery charges, where applicable, are displayed during checkout before an order is submitted.
Payment is processed using the payment methods offered through our checkout.
We may change prices at any time, but this will not affect an order that has already been accepted except where required by law or where an obvious pricing error has occurred.
4. DISPATCH AND DELIVERY
Our current dispatch schedule, delivery methods and charges are described in our Shipping Policy and/or during checkout.
Delivery dates and transit times are estimates unless we expressly agree otherwise.
We are not responsible for delays caused by circumstances genuinely outside our reasonable control. However, nothing in these Terms transfers to the customer any delivery risk that the law requires us to bear.
Customers should provide a complete and accurate delivery address and should make reasonable arrangements to receive perishable live plants.
5. LIVE PLANTS AND DELIVERY
Plants can experience temporary stress during transport. Minor cosmetic damage, temporary wilting, loss of an older leaf or other limited effects of normal transport do not necessarily indicate that a plant is faulty.
Significant transit damage, an incorrect plant, or a plant that is materially different from its description should be reported to us as soon as reasonably possible after delivery. Photographs of the plant and packaging may be requested so that we can assess the problem.
Our obligations in relation to damaged, faulty or misdescribed goods are not reduced by this section.
6. CANCELLATIONS, RETURNS AND REFUNDS
Returns, cancellations and refunds are governed by our Return and Refund Policy and applicable UK consumer law.
Live plants are perishable goods and may be exempt from the statutory cancellation right that applies to many other online purchases.
This does not affect a customer's statutory rights where goods are faulty, damaged, not as described or otherwise fail to conform to the contract.
Eligible non-perishable products remain subject to applicable statutory cancellation and return rights.
7. PLANT CARE AFTER DELIVERY
Plants are living organisms whose condition after delivery can be affected by temperature, light, watering, humidity, substrate, pests, disease, handling and other environmental factors.
Any cultivation, propagation or plant-care information provided by JungleBotanics is intended as general horticultural information. Customers remain responsible for providing appropriate conditions for their plants after delivery.
This section does not affect your rights concerning the condition or conformity of goods when supplied.
8. WEBSITE INFORMATION
We may update product descriptions, availability, prices and other website content from time to time.
We may correct typographical errors or inaccuracies where identified.
Educational articles, growing guides and plant-science material published on our website are provided for general informational purposes and should not be interpreted as a guarantee of a particular cultivation or propagation outcome.
9. INTELLECTUAL PROPERTY
Unless otherwise stated, content created by JungleBotanics for this website, including original text, photographs, graphics and branding, belongs to JungleBotanics Ltd or is used with appropriate permission.
You may access the website for personal, lawful use. You must not reproduce or commercially exploit our original content without permission except where permitted by law.
Third-party names, trademarks and other intellectual property remain the property of their respective owners.
10. ACCEPTABLE USE
You must not misuse the website, attempt to interfere with its operation or security, use it for unlawful purposes, or knowingly introduce malicious software.
11. THIRD-PARTY SERVICES
Our website may use services supplied by third parties, including Shopify and payment, delivery or analytics providers.
Third-party services may be subject to their own terms and privacy policies.
Although Shopify provides the e-commerce platform used by our store, purchases from JungleBotanics are made from JungleBotanics Ltd and not from Shopify.
12. PRIVACY
Personal information is handled in accordance with our Privacy Policy and applicable data-protection law.
Shopify and other service providers may process information where necessary to provide the technology and services used by our store.
13. LIABILITY AND STATUTORY RIGHTS
Nothing in these Terms excludes or restricts liability where doing so would be unlawful, including liability that cannot lawfully be excluded or restricted under UK consumer law.
Nothing in these Terms excludes or limits your statutory rights as a consumer.
Where permitted by law, we are not responsible for losses that were not reasonably foreseeable when the contract was formed or for losses resulting from circumstances outside our reasonable control.
If you are purchasing as a consumer, we do not exclude liability for losses where such exclusion would conflict with your statutory rights.
14. CHANGES TO THESE TERMS
We may update these Terms from time to time to reflect changes to our business, website, services or applicable requirements.
The version applicable to an order will normally be the version in effect when that order is placed.
15. GOVERNING LAW
These Terms are governed by the laws of England and Wales, subject to any mandatory consumer protections that apply to you.
If you are a consumer living elsewhere in the United Kingdom, you may also have rights to bring proceedings in the courts applicable to where you live.
